Wheel of Savings Terms and Conditions

In our Mishawaka, Indiana retail location we have the Wheel of Savings. The wheel has numbers 1 to 31. On the last day of every month (or next available business day), we will ask a random, walk-in customer to spin our Wheel of Savings. Whichever number it stops on, that date of the previous month becomes the Official-Lucky-Day-of-the-Month. (If it lands on an invalid date, like February 30th , the customer will spin again.) All enrolled customers online at PCDirect.com or in the PC Direct retail store who made purchases on that day will receive 100% refund (by return check) for their entire purchase(s) excluding sales tax.

For example, on May 31st a customer rolls our Wheel of Savings and it stops on the number 5. This means that April 5th becomes the Official-Lucky-Day-of-April. If you had made a purchase on April 5th and are enrolled in the promotion, you will get a refund (by return check) for the purchase price, excluding sales tax. So if John purchased a PC at $699 plus Tax, Mike purchased a USB cable at $3.99, and Jack purchased a TV at $299, and only John and Mike are enrolled in this promotion, John would receive $699 refund (by return check), and Mike would receive $3.99 refund (by return check). Since Jack did not previously enroll, he would not receive any refund.

How to enroll: Absolutely no purchase is necessary. There are two ways to enroll.

1. To become a member of www.PCDirect.com -----Open an account and subscribe to our e-mail news letter. Please note that only if you permit us to send you e-mail can we can notify you if you are a lucky winner. We promise not to bombard your e-mail account, and we will never sell your e-mail account.

2. To enroll at our retail store ------Our experienced sales staff will show you how to subscribe your e-mail so you can receive notification via e-mails.

PROMOTION PERIOD: We are committed to offer this promotion on a continuous basis. Please check on the last day of every month to see if you are one of the lucky ones to receive 100% refund (by return check) for your previous month's purchase (not including sales tax).

MONTHLY WHEEL ROLLING: To ensure authenticity of our lucky day spin, each and every rolling process of Wheel of Savings will be video taped and broadcast.

WINNER NOTIFICATION: The Lucky day of previous month will be announced immediately after the rolling process. Lucky customers will be notified primarily by e-mail or by phone within 7 business days. Winners who ordered online will receive their check via mail to the address provided within 4 weeks of the rolling process. Winners who purchased in the retail store must pick up their check in person within 30 days of the wheel spin: checks that are not claimed after 30 days will be voided. Upon receiving their refund checks, Lucky customers will have 90 days to deposit them. Refund checks will no longer be valid 90 days after being issued. If for any reason a refund check is not cashed, including but not limited to result of address change, result of lost mails, result of human errors, etc., we will NOT be able to re-issue a replacement check.

ACCOUNT OR REFUND UPPER LIMITS: There is no account limit. If a husband and a wife have two different accounts with us, and both of them made purchases on the lucky day, both of them will receive refund (by return check) if enrolled. There is NO upper refund limit. If someone purchased a $5,999 TV, he/she will receive $5,999 refund (by return check).

VERIFICATION: All refunds are subject to verification at the sole discretion of PCDirect and its authorized agents. Anti-fraud detection programs may be used for verification purposes. PCDirect and its authorized agents at their sole discretion may deny, cancel, and/or reverse any winnings to any individual customer when deemed fraud without further proof and/or explanations.

ELIGIBILITY: Promotion open only to customers 18 years of age or older. Checks are non-transferrable.

LIMITATIONS OF LIABILITY: No responsibility or liability is assumed by PCDirect and its agents for any technical problems or technical malfunction of any kind arising in connection with any of the following occurrences: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or telephone providers; garbled, jumbled or faulty data transmissions; failure of any e-mail or telephone transmissions to be sent to or received; lost, late, delayed or intercepted e-mail or text messaging transmissions; inaccessibility of the Web Site or phone system in whole or in part for any reason; traffic congestion on the Internet or Web Site or phone lines; unauthorized human or non-human intervention of the operation of the Promotion, including without limitation, human error, unauthorized tampering, hacking, fraud, theft, virus, bugs, worms; or destruction of any aspect of the Promotion or data thereof, including without limitation, tampering of or hacking into the telephone lines, or loss, miscount, misdirection, inaccessibility or unavailability of an Account used in connection with the Promotion. PCDirect reserves the right to cancel or suspend one or more refund in the event of one of the foregoing occurrences. PCDirect and its agents are not responsible for any personal injury or property damage or losses of any kind resulting from participation in the Promotion.

RELEASE OF LIABILITY: By participating in the promotion, all participants, on behalf of themselves, their executors, heirs and assigns, agree to release PCDirect and its agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property with participation in the Promotion.

CONDITIONS ON PARTICIPATION: By participating, all participants signify their agreement to be bound by these Official Rules, and the decisions of PCDirect and its agents whose decisions in all aspects shall be final and binding. PCDirect and its agents may, at their sole discretion, disqualify any individual from participating in any aspect of Promotion, and/or may cancel, suspend or block any customer's on-line or retail account registered by such person if Sponsor and its Administrators deem or suspect that such person have engaged in or have attempted to engage in any of the following but not limited to: (a) acting in violation of these Official Rules or the terms and conditions of the Web Site; or (b) damaging, tampering with or corrupting the operation of the Promotion; or (c) acting with intent to annoy, harass or abuse any other person; or (d) frequent returns after the release of winnings; or (f) any unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (g) activity deemed in the sole discretion of Sponsor and its Administrators to be generally inconsistent with the intended operation of the Promotion. CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE, CORRUPT, OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, PCDIRECT AND ITS AGENTS RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW.

MODIFICATION: In no event will PCDirect be obligated to award more prizes than the number of prizes stated in these Official Rules. If for any reason PCDirect determines in its sole discretion that the Promotion is no longer capable of running as intended by these rules for any reason whatsoever, PCDirect, at its sole discretion, reserves the right to cancel, terminate, suspend, postpone, delay or modify the Promotion in whole or in part, including without limitation at any time if any aspect of the Promotion is not capable of running as planned or as intended by these Official Rules.

PUBLICITY: Except for residents of TN and where prohibited by law, participants of this promotion grant to PCDirect the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known, including without limitation TV, radio, internet, the participant's name, picture if applicable or other likeness (including without limitation posting of name/city/state online at the Web Site within the participants board section) without additional compensation, for public relations, advertising and promotional purposes as may be determined by PCDirect, without additional compensation, consideration, review or consent in connection with this Promotion.
